Terms of Service

Scope

These Terms of Service govern your access to and use of Revive, including our iOS application, websites, content, software, features, tools, and related services that link to or reference these Terms.

Revive is a consumer photo-restoration service that may allow you to restore damaged or faded photographs, colorize black-and-white photographs, enhance portrait clarity, generate stylized or restored versions of uploaded photos, and, where available, create subtle animated versions of restored portraits.

Revive is an evolving software product. Features, workflows, output quality, supported file types, available plans, storage behavior, moderation practices, and third-party integrations may change over time without changing the basic applicability of these Terms.

Marketing materials, previews, screenshots, promotional pages, social content, and similar materials are provided for general informational purposes only and do not guarantee that any particular feature, output, subscription benefit, provider, or result is currently available in your region or on your device.

We may update these Terms from time to time. By continuing to access or use Revive after updated Terms become effective, you agree to be bound by the revised Terms.

Eligibility And Accounts

You may use Revive only if you are legally permitted to do so in your jurisdiction and under the rules of the platform through which you access the service, including Apple and the App Store.

Revive is intended for general consumers and is not directed specifically to children. If you are using the service on behalf of another person or household, you represent that you are authorized to do so.

Revive may be offered with or without user accounts at different times. If account-based features are offered, including Sign in with Apple or similar sign-in methods, you must provide accurate information, keep your credentials secure, and remain responsible for activity under your account.

License And Ownership

Subject to these Terms, Revive grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the service for your personal, non-commercial use.

Except for that limited license, Revive and its licensors retain all right, title, and interest in and to the service, including all software, designs, workflows, visual elements, brand features, and intellectual property rights.

You may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, decompile, attempt to extract source code from, or create derivative works of the service except to the extent that applicable law prohibits those restrictions.

These Terms do not transfer to you any ownership rights in Revive, and no implied licenses are granted except as expressly stated in these Terms.

Your Photos And Permissions

The service may allow you to select, upload, import, capture, store, scan, edit, organize, transform, and use photographs, portrait images, scans of printed photographs, albums, and related content that you submit or use with Revive ("User Content").

You retain ownership of your User Content. You represent and warrant that you own your User Content or have all rights, licenses, permissions, and consents necessary to use it with the service, including permission from any person whose photo you upload where required by law.

Because old photographs may contain family members, children, deceased relatives, or other third parties, you are responsible for determining whether you have an appropriate basis to upload, process, restore, colorize, enhance, or animate those photos using Revive.

You grant Revive a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, modify, adapt, display, process, and otherwise use your User Content and related outputs only as necessary to operate, maintain, secure, improve, and support the service, to route jobs through our providers, to enforce these Terms, and to comply with applicable law.

Unless we expressly tell you otherwise and obtain any consent required by applicable law, Revive does not use your User Content to train our own models. We may also seek to restrict our third-party vendors from training on submitted images and outputs, but service delivery may still require those providers to temporarily access and process submitted content on our behalf.

AI Processing And Outputs

Revive uses automated systems and may use third-party artificial intelligence, image-processing, animation, storage, analytics, moderation, logging, and infrastructure providers to process User Content and generate outputs.

Jobs may be routed among different providers or processing methods over time, including for restoration, colorization, enhancement, scratch or damage removal, scan cleanup, face sharpening, or portrait animation.

Outputs are AI-assisted, generated, estimated, enhanced, or restored results. They may vary in quality and accuracy and may include artifacts, reconstructed details, altered expressions, changed colors, modified textures, or results that do not match the original scene or person.

You acknowledge that restored, colorized, enhanced, or animated outputs are not guaranteed to be authentic, historically correct, preservation-grade, genealogically accurate, or faithful reproductions of the original photograph or subject.

You are responsible for reviewing outputs before relying on them for factual, archival, memorial, legal, editorial, genealogical, commercial, or other sensitive purposes.

Storage, Deletion, And Service Limits

Revive may temporarily store uploads, intermediate files, metadata, and generated outputs to provide the service, troubleshoot issues, prevent abuse, and improve reliability. If history, cloud gallery, account sync, or similar features are added, certain content may also be retained for longer periods as part of those features.

Revive is not a backup or archival service unless we expressly state otherwise. You should keep your own original copies of photographs, scans, and any outputs you wish to preserve.

Deletion timing, backup cycles, cache expiration, and provider-side retention may vary. We may offer deletion tools or honor deletion requests where required or reasonably practicable, but you understand that complete deletion from backups, logs, caches, or provider systems may not always be immediate.

We may set or change technical limits on file size, number of jobs, queue priority, supported formats, generation speed, access frequency, storage duration, and feature availability.

Acceptable Use

You may not use Revive, or any content used with Revive, in any way that is unlawful, fraudulent, infringing, defamatory, harassing, abusive, deceptive, harmful, or invasive of another person's rights.

You may not upload or process content if you do not have the legal right to do so, including photographs of third parties where you lack required permission or authority.

You may not use Revive to create deceptive, abusive, exploitative, sexually explicit, hateful, violent, or unlawful outputs, or to impersonate, harass, defame, or mislead others.

You may not interfere with or disrupt the service, attempt to gain unauthorized access to any system or account, scrape or automate access except through features we expressly provide, probe or bypass moderation or safety controls, or evade paywalls, usage limits, security controls, or technical restrictions.

We may, but are not required to, apply moderation, fraud detection, risk review, and safety filtering to uploads, outputs, purchases, and related activity.

Subscriptions, Trials, And Billing

Revive may offer paid subscriptions, limited previews, limited free restores, credits, feature-gated access, per-generation usage limits, or other freemium or paid access models. The app, App Store product page, purchase screen, and related Apple disclosures are the primary source of truth for current pricing, billing period, renewal terms, trial availability, credit allowances, credit usage, feature costs, and included features.

Subscription options, billing periods, credit systems, usage-based billing, and access tiers may vary over time. We may add, remove, or change credits or separate access tiers for more expensive processing features, including animation or video generation, at any time.

All billing, payment processing, renewals, cancellations, refund requests, and related account management for Apple in-app purchases are handled by Apple under your App Store account and Apple's applicable terms, policies, and settings.

We may change pricing, packaging, included features, or eligibility rules prospectively, subject to Apple's platform rules and any requirements under applicable law.

Feature Behavior And Disclaimers

Revive is an evolving software service, and certain features may depend on your device, operating system, network availability, photo quality, scan quality, source damage, permissions, local files, account state, and third-party services outside our direct control.

We do not guarantee that any photo can be restored, colorized, enhanced, or animated successfully, or that any output will preserve identity, likeness, facial details, family resemblance, emotional tone, age markers, background details, historical context, or original visual characteristics.

Outputs may be incomplete, distorted, delayed, unavailable, removed, or blocked for safety, policy, legal, or technical reasons.

To the maximum extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, or uninterrupted availability.

Termination And Changes

We may suspend, rate-limit, restrict, or terminate your access to all or any part of the service at any time, with or without notice, if we reasonably believe that you have violated these Terms, created legal or security risk, abused the service, attempted to evade commercial limits, failed to pay amounts owed, or otherwise exposed Revive, users, vendors, or third parties to harm.

We may modify, suspend, discontinue, or remove any part of the service at any time, including features, generation methods, provider relationships, moderation practices, purchase options, pricing, storage behavior, usage allowances, export functionality, device support, and platform compatibility.

If your access is terminated or suspended, we may also delete associated content, job history, or outputs in accordance with our operational practices, legal obligations, and applicable law.

Liability, Indemnity, And Legal Terms

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for any loss of profits, revenues, data, business opportunities, goodwill, sentimental value, memorial value, historical value, or other intangible losses arising out of or related to your use of the service.

Without limiting the foregoing, we are not responsible for inaccurate outputs, altered likenesses, lost data, deleted uploads, failed generations, delayed processing, provider outages, subscription interruptions, unsupported files, or your reliance on outputs for archival, genealogical, editorial, legal, memorial, or commercial decisions.

You agree to indemnify and hold harmless Revive and its affiliates, service providers, and partners from claims arising out of your unlawful use of the service, your User Content, your outputs, your violation of these Terms, or your violation of the rights of others.

These Terms are governed by the laws that otherwise apply to the operator of Revive, subject to any non-waivable consumer rights, app-store rules, and regional legal requirements that apply where you live or use the service.
